What is written on the Dubai rental law regarding the sharing of accommodation?
Sub-leasing or shared accommodation in Dubai is governed by Article 24 of Law No.26 of 2007. Based on this law the tenants have no right to share an apartment without the consent of the landlord unless it was included in the tenancy contract.
So, if you are planning to share your space with your friends, you need to seek approval from your landlord first.
If one brings in their friends to share the place without getting permission from the landlord, he/she can be asked to leave the place with the sub-tenants, regardless of the expiry of their tenancy period.
As Article 25 Law No. 33 of 2008 states “The landlord may demand the eviction of a tenant prior to the expiry of the tenancy period if the tenant subleases the property, or part thereof, without the landlord’s written approval and, in such a case, eviction shall be applicable to the tenant and the sub-tenant.”
Apartment sharing rules and regulations:
- You are required to take permission from the landowner before letting in any co-tenant.
- The sub-tenants will get to enjoy the same privilege as the real tenant like swimming pools, gyms, parking areas, and more.
- The tenants and the sub-tenants get to enjoy the amenities unless they disturb their neighbors while residing there.
- Sub-lease contracts shall define the relationship between tenant and sub-tenant. Regardless of their relationship, the obligation of the tenant towards the landlord will remain the same as previously agreed upon.
One must know that the number of sub-tenants depends on the area where the property is located.
Can unmarried couples legally share the accommodation in Dubai?
Until the new personal and family laws, it was illegal for unmarried couples to legally share the accommodation. But now according to the new law, it is legal for the opposite genders to share accommodation in Dubai.
This law applies to all types of accommodation including hotel rooms, houses, and apartments for rent in Dubai.
Rules for bachelors:
It can be a difficult task to find accommodation for both bachelor and single women. Even though cohabitating with the opposite gender is not illegal anymore, singles must abide by the Dubai Rental Law on shared accommodation to avoid unnecessary fines.
The basic rule remains that singles can share their apartments with anyone but they can do this only with the permission of the landlords.
So the main point here is if someone wants to sublet his/her place they must have a landlord who has no problem with sub-letting the accommodation.
So once the landowner agrees to sub-let the place, tenants also need to fulfill the requirements set by the Dubai Municipality.
However, Bachelors sharing apartments in Dubai can be asked to evict if they’re found to be involved in any illegal or antisocial behavior such as loud music, drug consumption, etc.
Policies for Ejari Registration:
Tenants and landlords register the Tenancy Contract with Ejari, a regulatory system for checking rental contracts in Dubai for both freehold and non-freehold properties.
Whereas while talking about the sub-tenants policies, it is a bit different. The registration is given to the tenant but if the tenant decides to sub-let the place without seeking approval from the landlord first, the sub-tenant will get no help from the system.
